NEW ORLEANS, LA (NBC33) — UPDATE: Brian Downing says he's not guilty.
That plea came today in orleans parish criminal court.
Downing was arraigned this morning on one count of sexual battery and another count of obscenity.
ORIGINAL STORY: A grand jury has indicted the man accused of simulating a sex act on an unconscious LSU fan after the BCS Championship Series game.
Brian H. Downing, 32, is charged with one count of sexual battery and one count of obscenity, according to WDSU, the NBC affiliate in New Orleans. That decision was handed down on Thursday, May 17.
Downing’s bond has been set at $50,000.
The incident happened in the early morning on January 9, following the BCS game in New Orleans. Downing is accused of placing his genitals on the unconscious LSU fan. The incident was recorded and posted to YouTube. It quickly went viral and captured national attention.
Downing was identified and arrested  by the New Orleans Police Department.
The victim in this case has filed a lawsuit  against Downing as well as the owner and operator of the business in which the incident occurred.
