NBC NATIONAL NEWS — Senior police officer Jaime Padron responded to a 911 call of a drunken man walking around a Wal-Mart parking lot in Austin, Texas.
It was inside the Wal-Mart where Padron tried to talk to the suspect but instead the suspect tried to fight the officer.
"During the fight the suspect produced a semi-automatic pistol, shot the officer at point blank, striking him in the neck area," said Chief Art Acevedo of the Austin Police Department.
Amazingly Padron was able to radio dispatch to say he was shot.
A second officer arrived within seconds of the shooting and arrested the suspect then performed CPR on Padron before EMS arrived.
But within 20 minutes, Acevedo said that Padron had "succumbed to his injuries."
He was pronounced dead at the scene.
Officials believe all of this was caught on camera since it was inside Wal-Mart and that will be part of the investigation.
