NBC NATIONAL NEWS — The man accused of one of America's worst mass-shootings, James Holmes, has been formally charged with 142 counts, including First-Degree Murder.
Holmes allegedly shot and killed a dozen people and injured dozens of others in a Colorado movie theater earlier this month.
For the first time, James Holmes officially heard what he faces in connection with the shooting deaths of 12 people and the injuries of 58 others, and for booby-trapping his apartment, allegedly with intent to kill.
Unlike last week’s initial court appearance, this time cameras were not allowed in the courtroom.
Attorneys also argued whether a notebook Holmes allegedly mailed to his psychiatrist before the shooting should be allowed as evidence. Unconfirmed reports say the notebook contained detailed plans for the massacre. Defense attorneys say the information is privileged – doctor-patience communication.
As for seeking the death penalty, prosecutors want input from victim’s families and survivors before announcing whether to seek the death penalty.
Holmes will not face an additional homicide charge after one of his victims critically injured, Ashley Mosher, suffered a miscarriage. Mosher had been shot in neck and abdomen. Her six-year-old daughter Veronica was killed in the attack.
