A lawsuit between Port Allen Mayor Deedy Slaughter and the city's chief financial officer Audrey McCain is going to trial.

Wednesday, the two met in court in person for the first time for a motion hearing on a summary judgement. The mayor's lawyer filed a motion allegedly the McCain claims didn't have material fact ' and therefore the lawsuit should be thrown out.

West Baton Rouge Judge Alvin Batiste decided to dismiss part of the mayor's request to throw out a lawsuit against her and ruled that a trial is the next step.

The legal battle began when the mayor fired McCain without the city councils approval. McCain filed a suit alleging she was wrongfully terminated.

Lawyers for both sides say they are ready for the trial.

"We believe we have a substantial argument to prevail on the merits. the mayor feels good about what went on today and she is going to lead port allen as she has done since she took office," Ronald Johnson, Attorney for the mayor, said.

"We're happy with the ruling today it's a huge progress and it's good for the people of Port Allen," Seth Dornier, Attorney for McCain, said. "We are ready to go to trial we need no delay we are ready to go."

The two sides will return to court for a hearing on August 28. The trial is tentatively set for September 19.
