Texas Brine: 43 out of 92 buyout offers accepted by residents of Bayou Corne

Texas Brine has completed its settlement offers to residents located near the Bayou Corne sinkhole.

Officials say Texas Brine presented a total of 92 settlement offers since the process began on May 24, 2013.

As of June 24, 2013:

  • 92 offers delivered to residents
  • 88 offer responses from residents received
  • 89 responses to resident counter-offers distributed
  • 43 offers accepted

For those residents who have reached a settlement agreement with Texas Brine the next step in the process will be to close on all property, and execute release and settlement documents. The process is expected to take 30-45 days.

“Residents not satisfied with their offers had the opportunity to present counter-offers along with supporting documentation or request non-binding, third party mediation of their claims,” a press release stated. “Each claim was evaluated on an individual basis in order to support a reasonable settlement offer.”

Some of those who did not accept the offer say it’s because the offers from the company were too low.

"I am not surrendering by any means," Shelly Hernandez, Bayou Corne property owner, explained. "I may be torn tattered worn. I am not surrendering. It may bring me to my grave, but I'm not."

We’re told 42 residents expressed an interest in continuing direct negotiations with Texas Brine and have agreed to participate in non-binding mediation of their claims. For this reason, Texas Brine has requested that the negotiation process be extended until July 31. The Judge has not yet ruled on this request.

If the Judge does not allow the extension, all remaining negotiations must go through legal council.
