BATON ROUGE, LA (NBC33) — THIS IS AN NBC33 NEWS UPDATE: The jury has found Trucko Stampley guilty on all four counts of murder.
ORIGINAL STORY: After a week of testimony the fate of alleged murderer Trucko Stampley is now in the hands of a jury of nine men and three women. They have to decide whether Stampley murdered four people, the Pedescleux’s and the Colvins’ back in April 2007.
Closing arguments began with prosecutor Darwin Miller saying that the evidence overwhelming tied Stampley to all four murders. This included DNA evidence taken from both crime scenes. This also included the same gun being used at the two crime scenes.
Additionally, Trucko's confession while on the phone to his ex-girlfriend.
Daryl Gold of the defense not disputing that the DNA evidence linked Trucko to the crime scenes. However, he did say that Trucko was not sane at the time of the alleged murders. Gold also believes that because Trucko is mentally retarded, he didn't know the difference between right and wrong.
Only ten of the 12 jurors need to agree on the verdict.
This is because the death penalty was taken off the table by prosecution before the trial started.
Jurors have to decide whether Trucko is guilty, not guilty or not guilty by reason of insanity.
