August 3, 1982 - Georgia Arrest Sparks Sexual Privacy Debate

On this day in 1982, Michael Hardwick was arrested for sodomy after a police officer observed him engaging in homosexual activity in his bedroom in Georgia. The constitutionality of the Georgia law criminalizing sodomy was upheld by the U.S. Supreme Court in a 1986 decision. But on June 27, 2003, in the Lawrence v. Texas decision, the U.S. Supreme Court declared that a Texas law prohibiting gay sodomy was unconstitutional, thereby reversing the holding in the Michael Hardwick case.
